GENERAL WARRANTY CONDITIONS FOR PRODUCTS
ARDEN S.C. DOROTA STILLER, BRONISŁAWA ADAMCZAK, JULIUSZ ADAMCZAK, with its registered office at Sycowska Street 15, 60-003 Poznań, entered in the Central Register and Information on Economic Activity of the Republic of Poland, maintained by the minister responsible for economy, under the tax identification number (NIP): 7792121526 and statistical number (REGON): 639767451, hereinafter referred to as the "Guarantor," ensures the highest quality of its products and services.
§ 1 GENERAL PROVISIONS
The Guarantor provides a 12-month warranty for products offered for sale in its Store, calculated from the date of purchase of the product documented by an invoice or receipt.
The warranty is valid within the territory of the European Union.
This warranty covers:
material defects,
manufacturing defects,
any other defects resulting from causes inherent in the product.
Under the warranty, the customer has the right to free removal of the reported and warranty-covered defect within an individually agreed timeframe, or to exchange the product for a new one or another with the most similar parameters. The Guarantor decides on the exchange of the product for a new one if the repair is not justified. If, for any reason, the exchange of the product for a new one is also not justified, the Guarantor may decide to refund the price. In each case, the Guarantor decides on the validity of the warranty claim after a thorough analysis.
The responsibility for correctly taking measurements from the horse, in accordance with the form provided by the Guarantor on the website www.ardenharness.com, lies with the customer. Leather harnesses made to individual order and according to the measurement form, as well as Biothane harnesses with colored edging made according to the customer's wishes, are not subject to exchange.
In case of noticing any damage or irregularities in products purchased from the Guarantor, the customer should:
stop using the product,
immediately inform the Guarantor.
In case of wishing to use the warranty, the Guarantor must first be informed of this fact. Shipments sent cash on delivery will not be accepted.
The warranty does not cover:
mechanical damage such as cuts, abrasions, cracks, scratches, tears, and other damages not resulting from defects existing in the product,
mechanical wear of the product resulting from its normal use,
wear of consumable parts,
damage to products resulting from improper maintenance and storage in a manner inconsistent with the Guarantor's recommendations,
loss of product color resulting from the customer's failure to follow the Guarantor's instructions regarding product cleaning,
consequences of using the product inconsistently with its intended purpose,
consequences of soaking and overloading,
products that have been subject to self-repair attempts or interference by third parties and external services,
damages caused by external forces unrelated to the product covered by the warranty (e.g., frost, fire, natural disasters, force majeure, etc.).
Products sent to the Guarantor for repair must be clean and washed, as well as packed and arranged in a box. Products sent for exchange must be clean and washed, packed and arranged in a box, and must not show signs of use. If the products are not clean or show signs of use, the Guarantor may refuse the exchange or repair.
Failure to meet the above conditions will result in the loss of the warranty.
§ 2 CLAIM
To file a warranty claim, the Guarantor must be informed of the observed defects, documented for the purpose of verifying the claims and possibly removing the defects without the need to send the product back to the Guarantor.
If it is necessary to send the product back to the Guarantor, the Guarantor will inform the claimant within 14 days from the date of the claim.
Claims can be made electronically to the Guarantor's email address provided on its website or in writing to the address provided above.
The Guarantor will promptly, but no later than 14 days from the date of receiving the shipment with the product from the customer, take a position on the claim and inform the customer of further steps. The Guarantor will promptly notify the claimant in writing or via email to the email address provided in the claim about the result of the claim review.
The transport of the product covered by the claim is at the Guarantor's expense through the shipping method indicated by the Guarantor. In some cases, it is not necessary to send the claimed product, and the Guarantor may rely on the inspection of photos provided by the customer, which will be communicated after receiving the claim.
The claim will be rejected if the symptoms are not provided.
The product to be sent must be thoroughly cleaned and properly secured for transport.
§ 3 EXCLUSIONS
The warranty does not cover, in particular, regular and periodic maintenance of the product, including cleaning.
The Guarantor is not responsible for the consequences resulting from the improper operation of the product.
All costs related to the execution of the warranty (including the cost of transporting the product to the Guarantor's headquarters) are borne by the Guarantor. In case of an unjustified claim by the user for repair or unjustified exchange under the warranty, the user is obliged to cover all costs incurred by the Guarantor in connection with the actions taken as a result of this claim, including transport to the Guarantor.
The Guarantor is not responsible for damages resulting from the existence of a defect, including loss of income, damage to the company's reputation, and accidental damage to the product not caused by reasons inherent in the repaired item.
§ 4 FINAL PROVISIONS
This warranty does not exclude, limit, or suspend the customer's rights resulting from the provisions on warranty for defects in the sold item. Claims under the warranty and claims under the warranty for defects are separate and independent, so the customer has the right to pursue their rights on both grounds against the responsible entities.
